...I was arrested years ago and have worked very hard since those years in getting myself healed and improving my life. Oregon law allows for some crimes to be completely cleared from a person’s record, a process known as expungement. Oregon's expungement law enables that person to seek employment and housing without having to explain a prior criminal conviction. Although there are exceptions (sex crimes and traffic offenses cannot be expunged), for many people, an expungement can be a final act of rehabilitation. It is in a person’s best interest to seek an expungement at the earliest possible opportunity.

Expungement Restrictions
Generally, in order to qualify for expungement, a conviction must be a class "C" felony, misdemeanor, or a violation. Certain offenses are not eligible for expungement, such as sex crimes, and traffic offenses. Other restrictions:
- There must not be any other criminal conviction on your record for the 10 years preceding expungement. Oddly enough, this rule makes it so that a person can sometimes expunge more recent convictions sooner than older ones.
- You must not be facing current criminal charges.
- You must have fulfilled the requirements of your sentence as ordered by the court.
- You must wait at least 3 years after the date of conviction. There is no waiting period required to expunge an arrest for a dismissed/acquitted case or one resulting in a not guilty verdict, as long as the other requirements are satisfied.

Expungement Fees
The total out-of-pocket cost of a basic expungement motion is $680. Our fee is $600 and the state requires an $80 processing fee. An expungement motion may be more costly if it involves expunging a record that is very old, or one with other irregular aspects. Also, it may be more expensive if we anticipate that the District Attorney will contest the expungement, requiring additional court proceedings. If you have several expungements, we may be able to offer you a package for a reduced fee.
The total fee for expungement motions filed with Multnomah County Circuit Court is generally $580 total, a $100 reduction due to its proximity to our office.
